ARMED FORCES AND THE 1988 CONSTITUTION
NORMATIVE BASIS FOR A PROJECT OF DEMILITARIZATION OF POLITICS

The article has the general objective to analyze, from the Brazilian law perspective, the armed forces functions, giving special attention to two topics of legal controversy: the function provisioned by Article 142 of the 1988 Constitution of guaranteeing constitutional powers; and the function of guaranteeing of law and order during electoral processes through operations to guarantee voting and counting. Specific objectives are to catalog the elements for understanding and critique the role of the armed forces in Brazil, especially in view of the development of the military protagonist power in government and the intense involvement of the institution in the 2022 electoral process, which sought to legitimize itself through legal discourse. The hypothesis is that it is necessary to deepen the debate about civil-military relations in the field of law, in order to build a normative approach capable of delimiting the scope of the armed forces’ functions, rescuing the basis of the project of demilitarization of national policy.
