In his Theory of Justice, Tércio Sampaio Ferraz Júnior raises an important epistemological problem: can justice, understood as a virtue, as a feeling, affection, or other emotional component in action, or as a decision-making technique, be treated theoretically, that is, as an idea? The answer is based on his analytical-pragmatic model, in which both quantitative and qualitative perceptions emerge, clearly linked to fundamental rights and values, brought together in human dignity, which brings him closer to understanding law as an ethical maximum, concerning its extension, which is to all human beings, and according to a content, which is the set of values at the summit of Western culture, established as fundamental rights in constitutions. As a result, this article aims to establish a dialogue between Tércio Sampaio Ferraz Júnior's Theory of Justice, particularly his concept of justice in the act of judging, and Joaquim Carlos Salgado's ethical maximum, presented in the book The Idea of Justice in the Contemporary World.
