Abstract

This article intends to explore the theoretical potential of Roberto Esposito´s investigation on the relation between personality and the immunization of community for analyzing the multidimensional role of violence in criminal law. Two specific questions guide the research: how an analysis of the paradigm of immunization, in the context of criminal law, could be relevant to think the different ways that legal subjectivity is established before law? In what degree the analytical category of person, itself a specific expression of legal subjectivity, brings with itself possibilities of expropriation of that same legal subjectivity? Through a literature review of the work of Roberto Esposito and theorists´ with similar theoretical interests, this research defends that an understanding of the legal realm that is based on legal personality is one of the principal reasons of the disjointment between sovereign power and the legal norms which constrain that power.
